3D Concepts Canada operates various brands, divisions, and product lines, including:

  • VX Organizers

  • Voxel Vista Designs

  • Vertex Performance Systems (VPS)

  • Other brands, divisions, and product lines that may be introduced by 3D Concepts Canada.

Unless expressly stated otherwise, these brands and divisions operate under 3D Concepts Canada.

These Terms apply to the 3D Concepts Canada website, including its associated pages, online stores, product listings, services, inquiries, and purchases made through the website.

By accessing or using the website, submitting an inquiry, creating an account, or purchasing a product or service through the website, you agree to these Terms to the extent permitted by applicable law.

If you do not agree with these Terms, you should not use the website or purchase products or services through it.

2. Eligibility

You must have the legal capacity to enter into a binding agreement in the jurisdiction in which you reside.

If you are under the age of majority in your jurisdiction, you may only use the website or purchase products with the involvement and authorization of a parent or legal guardian where required by law.

You agree to use this website only for lawful purposes and in accordance with applicable Canadian, provincial, territorial, and local laws.

3D Concepts Canada may offer products and services including, but not limited to:

  • 3D-printed products and components;

  • Tool organization and storage products;

  • Custom-designed and manufactured products;

  • Branded merchandise and apparel;

  • Promotional products;

  • Laser-engraved products;

  • Vinyl and heat-transfer products;

  • Custom signage;

  • Automotive components and accessories;

  • Custom engineering and design services;

  • Product design and development; and

  • Other manufacturing, fabrication, design, and related services.

Product availability, specifications, materials, colours, dimensions, pricing, and other information may change without notice.

We make reasonable efforts to ensure that product information is accurate. However, minor variations may occur, particularly with products that are 3D printed, manufactured, engraved, fabricated, or customized.

4. Product Images and Specifications

Product photographs and images are provided for illustrative purposes unless otherwise stated.

Colours may appear differently depending on your display, device, browser, lighting conditions, photography, and the characteristics of the material used.

Manufactured products may have minor variations in:

  • Colour;

  • Texture;

  • Surface finish;

  • Dimensions;

  • Layer lines;

  • Seam lines;

  • Manufacturing marks;

  • Engraving appearance; and

  • Other characteristics inherent to the manufacturing process.

Minor variations that do not materially affect the product's intended function are not necessarily considered defects.

Where exact specifications are important to an intended application, customers are responsible for confirming those specifications with us before ordering.

5. Orders and Order Acceptance

Submitting an order through the website constitutes an offer to purchase the applicable products.

An automated order confirmation does not necessarily constitute final acceptance of an order.

We reserve the right to accept, decline, cancel, or limit an order where permitted by law, including where:

  • A product is unavailable;

  • An obvious pricing or listing error has occurred;

  • Information provided is incomplete or inaccurate;

  • An order appears fraudulent or unauthorized;

  • A product cannot reasonably be manufactured or supplied;

  • A technical error has affected the order;

  • Shipping to the requested destination is unavailable; or

  • Other circumstances make fulfillment impossible or unreasonable.

If an order is cancelled after payment has been received, any amount paid for the cancelled portion of the order will be refunded using the original payment method, subject to applicable law.

6. Pricing and Taxes

All prices displayed on the website are in Canadian dollars (CAD) unless otherwise stated.

Prices are displayed before applicable taxes unless expressly stated otherwise.

Applicable GST and other taxes will be calculated and charged where required by law.

Prices may change without notice before an order is accepted.

We reserve the right to correct typographical, technical, pricing, or other errors appearing on the website.

If an obvious pricing error affects an order, we may cancel the affected order and refund any amount paid.

Promotional pricing, discounts, coupons, and other offers may be subject to additional terms and may not be combined unless expressly stated.

7. Custom and Made-to-Order Products

Certain products may be produced specifically according to customer requirements.

Custom or made-to-order products may include customized:

  • Colours;

  • Names;

  • Logos;

  • Text;

  • Dimensions;

  • Configurations;

  • Materials;

  • Designs;

  • Branding;

  • Artwork; or

  • Other specifications.

Customers are responsible for ensuring that information supplied for a custom order is accurate.

Once production has commenced, changes or cancellations may not be possible.

Return, cancellation, and refund eligibility for custom or made-to-order products is governed by our applicable Return & Refund Policy and applicable law.

8. Customer-Supplied Artwork and Content

If you provide artwork, logos, photographs, designs, files, trademarks, text, or other material to us ("Customer Content"), you represent that you have the necessary rights, permissions, licenses, or authority to provide that material and request its use.

You must not provide Customer Content that infringes another person's or organization's:

  • Copyright;

  • Trademark;

  • Patent;

  • Industrial design;

  • Privacy rights;

  • Publicity rights; or

  • Other legal rights.

You remain responsible for the Customer Content you provide.

By submitting Customer Content for an order, you grant 3D Concepts Canada the limited permission necessary to reproduce, modify, process, manufacture, print, engrave, cut, or otherwise use that material solely for fulfilling your requested product or service.

We may refuse to produce content that we reasonably believe is unlawful, infringing, misleading, abusive, or otherwise inappropriate.

9. Intellectual Property

Unless otherwise stated, content appearing on this website is owned by or licensed to 3D Concepts Canada.

This includes, without limitation:

  • Logos;

  • Brand names;

  • Product photographs;

  • Graphics;

  • Illustrations;

  • Website content;

  • Product descriptions;

  • Original designs;

  • CAD files;

  • 3D models;

  • Engineering designs;

  • Trademarks;

  • Trade names;

  • Videos;

  • Documentation; and

  • Other intellectual property.

You may view website content for personal or legitimate business purchasing purposes.

You may not, without prior written permission:

  • Copy or reproduce our proprietary designs;

  • Redistribute our content;

  • Commercially exploit website content;

  • Reproduce or distribute our CAD files or 3D models;

  • Reproduce our photographs or graphics;

  • Remove copyright or trademark notices;

  • Reverse engineer proprietary designs for commercial reproduction; or

  • Create derivative commercial products from proprietary designs.

Purchase of a physical product does not transfer ownership of the underlying CAD file, digital model, design, engineering work, intellectual property, or manufacturing process unless expressly agreed to in writing.

10. 3D-Printed and Manufactured Products

3D-printed products are manufactured using additive manufacturing processes and may contain characteristics inherent to those processes.

Depending on the product, these may include layer lines, surface variation, minor dimensional variation, seam lines, support marks, or other manufacturing characteristics.

Unless expressly stated otherwise, products should not be assumed to be certified, tested, safety-rated, or approved for a particular application.

Customers are responsible for determining whether a product is appropriate for their intended use.

11. Automotive and Performance Products

Certain products offered through Vertex Performance Systems (VPS) or other automotive-related product lines may be intended for automotive, motorsport, off-road, performance, or mechanical applications.

Unless expressly stated otherwise, products are not represented as being suitable for:

  • Safety-critical systems;

  • Emergency systems;

  • Braking systems;

  • Steering systems;

  • Restraint systems;

  • Emissions-control systems;

  • Other legally regulated systems; or

  • Applications where failure could reasonably result in serious injury, death, or significant property damage.

Customers are responsible for determining the suitability of a product for their specific vehicle and application.

Where appropriate, installation should be performed by a suitably qualified person.

Any performance, horsepower, airflow, efficiency, durability, or other technical claims apply only to the conditions and configurations expressly described with the applicable product.

12. Product Safety and Intended Use

Products must be used only for their intended purpose and in accordance with any instructions, warnings, or documentation provided with the product.

Customers are responsible for:

  • Proper installation;

  • Proper use;

  • Compatibility;

  • Maintenance;

  • Inspection;

  • Safe operating conditions; and

  • Compliance with applicable laws and regulations.

Products must not be used in applications for which they were not designed.

Where a product is used in a modified, extreme, high-load, high-temperature, outdoor, automotive, industrial, or otherwise demanding environment, the customer is responsible for determining whether the product is suitable for that environment.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

13. Shipping and Delivery

Shipping methods, costs, delivery estimates, and available destinations may vary depending on the product, order size, destination, and shipping provider.

Any delivery date or timeframe provided is an estimate unless expressly guaranteed in writing.

We are not responsible for delays caused by circumstances outside our reasonable control, including:

  • Carrier delays;

  • Severe weather;

  • Natural disasters;

  • Labour disruptions;

  • Customs processing;

  • Government restrictions;

  • Transportation disruptions;

  • Incorrect customer information; or

  • Other circumstances beyond our reasonable control.

Customers are responsible for providing accurate shipping information.

Additional charges resulting from an incorrect or incomplete shipping address may be the customer's responsibility where permitted by law.

For international orders, customers may be responsible for customs duties, import taxes, brokerage fees, or other destination-country charges unless expressly stated otherwise.

14. Returns, Refunds and Exchanges

Returns, refunds, exchanges, cancellations, and warranty claims are governed by our applicable Return & Refund Policy, together with any product-specific terms.

Certain custom, personalized, made-to-order, clearance, or otherwise specified products may have different return eligibility, subject to applicable law.

Customers should inspect products promptly after delivery and contact us as soon as reasonably possible if an item appears damaged, defective, incorrect, or materially different from what was ordered.

Nothing in our policies is intended to remove or restrict any rights or remedies that cannot legally be excluded under applicable consumer-protection legislation.

15. Product Warranties

Where a product is provided with a specific written warranty, that warranty governs the applicable warranty coverage.

Unless expressly stated otherwise, no additional warranty is created merely by a product description, photograph, marketing statement, or general statement concerning product performance.

Nothing in these Terms excludes or restricts statutory warranties, guarantees, conditions, or consumer rights that cannot legally be excluded.

16. Website Availability

We make reasonable efforts to maintain the availability and functionality of the website but do not guarantee that the website will always be:

  • Available;

  • Uninterrupted;

  • Secure;

  • Error-free;

  • Complete; or

  • Free from viruses or other harmful components.

To the maximum extent permitted by applicable law, our aggregate liability relating to a particular product or transaction will not exceed the amount actually paid by the customer for the specific product or service giving rise to the claim.

This limitation does not apply to liability that cannot legally be limited or excluded.

Nothing in these Terms is intended to exclude or restrict rights or remedies provided to consumers under applicable law.

21. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless 3D Concepts Canada and its owner from claims, losses, damages, liabilities, costs, and reasonable expenses arising from:

  • Your unlawful use of the website;

  • Your violation of these Terms;

  • Your infringement of another party's intellectual property rights;

  • Customer Content supplied by you;

  • Your misuse of a product; or

  • Your violation of applicable law.

This section does not apply to the extent that a claim results from our own negligence, willful misconduct, or liability that cannot legally be transferred to you.

22. Force Majeure

We will not be responsible for failure or delay in performing our obligations where the failure or delay results from circumstances beyond our reasonable control.

Such circumstances may include natural disasters, severe weather, fire, flood, war, civil unrest, government action, transportation disruptions, labour disruptions, supply-chain disruptions, equipment failure, utility outages, internet outages, or other events beyond our reasonable control.

Changes will not retroactively alter an accepted order except where permitted by law or where necessary because of circumstances such as an obvious error, product unavailability, fraud, or circumstances making fulfillment impossible.

  • Product-specific warranty;

  • Quotation;

  • Order confirmation;

  • Written agreement; or

  • Other expressly incorporated terms,

constitute the agreement governing the applicable transaction or use of the website.

Where a specific written agreement or product-specific term conflicts with these Terms, the specific agreement or term will govern to the extent of the conflict.
